1.1 These Terms and Conditions (“Terms”) apply to all orders placed with KWG Electric, 8 Roundham Road, Paignton, Devon TQ4 6DN, trading as The Pump Dealer (“we”, “us”, “our”).
1.2 Orders may be placed via:
a) our website www.thepumpdealer.co.uk and associated online marketplaces; or
b) telephone or email.
1.3 The Website is intended for use by purchasers located in the United Kingdom, Republic of Ireland, Channel Islands and Isle of Man.
1.4 By placing an order you confirm that you are aged 18 or over.
2.1 By placing an order you agree to be bound by these Terms together with our Privacy Policy and Website Conditions of Use.
2.2 Nothing in these Terms affects your statutory rights as a consumer.
3.1 Your order constitutes an offer to purchase.
3.2 A contract is formed only when we:
a) confirm availability; and
b) dispatch the goods or issue a dispatch confirmation email.
3.3 We reserve the right to refuse or cancel any order at our discretion.
4.1 Prices are in GBP.
4.2 Prices shown on the website include VAT unless otherwise stated.
4.3 Some items are sold under the VAT Margin Scheme and will not show reclaimable VAT.
4.4 Delivery and packaging charges are additional unless stated as free.
4.5 Errors in pricing may occur. We will contact you and offer the option to reconfirm or cancel.

5.1 Risk passes to you upon delivery.
5.2 For international deliveries, all import duties and taxes are your responsibility.
5.3 Delivery dates are estimates only and not guaranteed.
6.1 Product images and specifications are provided in good faith but may vary.
6.2 We do not guarantee suitability for a particular application unless expressly agreed in writing.
7.1 Definition
Goods not held in our stock and procured specifically for your order are “Special Order Goods”.
7.2 Non-Cancellable
Once ordered with the manufacturer, Special Order Goods are non-cancellable and non-returnable except where:
a) the goods are defective; or
b) not supplied in accordance with the agreed specification.
7.3 Buyer Acknowledgement
By ordering Special Order Goods you accept they cannot be cancelled for change of mind, ordering error, or incompatibility.
8.1 Where we agree (at our discretion) to accept return of non-fault goods, a restocking fee of 40% of the invoice value shall apply.
8.2 Additional deductions may include:
manufacturer charges
carriage costs
handling fees
8.3 Restocking fees do not apply to proven manufacturing defects.
9.1 The Seller does not undertake hydraulic design, system integration, or suitability verification unless agreed in writing.
9.2 The Buyer is responsible for:
equipment selection
compatibility
duty requirements
installation compliance
9.3 Any technical information is guidance only and does not constitute design approval.
10.1 Payment is required prior to dispatch unless credit terms are agreed.
10.2 For Special Orders we may require:
100% pro-forma; or
non-refundable deposit.
11.1 Risk passes on delivery.
11.2 Title passes only when payment is received in full.
12.1 You have 14 days from receipt to notify cancellation.
12.2 You then have 14 days to return goods at your cost.
12.3 Refunds will be issued within 14 days of receipt.
12.4 This does not apply to Special Order Goods (see Section 7).
13.1 Faults must be reported within 30 days.
13.2 Pumps will be inspected to determine:
manufacturing defect → refund/replacement
installation error → no refund.
13.3 A full pump report will be provided upon request.
14.1 Returns will not be accepted if:
the item has been unpacked and installed.
14.2 Non-fault returns are subject to Section 8 (40% fee).
15.1 Site visits may require pre-authorisation.
15.2 If fault is not covered, charges will apply.
16.1 Our liability will not exceed the price paid.
16.2 We are not liable for business losses including:
loss of profit
downtime
consequential loss.
17.1 We are not liable for events beyond our control.
18.1 English law applies.
18.2 Jurisdiction of English courts.
